This Privacy Policy describes how we collect, use, disclose, and retain personal information in connection with our training programs, websites, online store, booking systems, online learning platforms, communication channels, and related services. This Policy is intended to comply with the Personal Information Protection and Electronic Documents Act (PIPEDA), Canada's Anti-Spam Legislation (CASL), and, where applicable, provincial privacy legislation. Where McCann Dogs sends text messages to residents of the United States, those communications are also governed by the Telephone Consumer Protection Act (TCPA) and applicable regulations of the Federal Communications Commission (FCC). Where we refer to "personal information," we mean information about an identifiable individual, as defined under applicable law. 1. Personal information is collected for the following purposes: Training Programs and Service Delivery Enrolling individuals in group classes, private lessons, workshops, and online programs Assessing and tracking training progress Communicating with students, guardians, and related parties regarding program delivery Issuing receipts, invoices, and certificates eCommerce and Order Fulfillment Processing purchases made through our online store Coordinating shipping, fulfillment, and returns Managing customer accounts and purchase history Marketing and Communications Sending promotional emails, newsletters, and training resources to subscribers who have opted in Measuring engagement with marketing campaigns and content Improving and personalizing website and user experience Call Tracking and Attribution (WhatConverts) We use WhatConverts, a third-party lead tracking platform, to capture and analyze inbound communications. This includes: Dynamic telephone number insertion (DNI), which temporarily displays unique tracking phone numbers to website visitors for the purpose of attributing calls to specific marketing sources, channels, or campaigns Recording of inbound telephone calls, where permitted by applicable law AI-assisted transcription and summarization of recorded calls Capture of caller identification, call duration, call source attribution data, and lead disposition notes Tracking of form submissions, chat interactions, and other lead events The purpose of this collection is to measure the effectiveness of our marketing activities, improve how we respond to leads, and support staff training and quality assurance. Call recordings and transcripts may be retained for internal business purposes for a period consistent with those needs. Callers will be notified at or before the outset of a call that the call may be recorded. By continuing a call after such notification, callers are taken to have consented to recording for the purposes set out above. SMS and Text Message Communications Where you have opted in to receive text messages from McCann Dogs, we collect and use your mobile telephone number to send transactional updates, promotional content, training resources, and cart reminder messages, as further described in Section 14 of this Policy. Analytics and Website Performance Monitoring website traffic, session behavior, referral sources, and conversion activity Identifying technical issues and improving site performance Measuring advertising effectiveness across platforms Legal and Operational Obligations Complying with applicable laws, regulations, and court orders Preventing fraud, misuse, or unauthorized access Resolving disputes and enforcing agreements 3. Consent McCann Dogs relies on express or implied consent as the basis for collecting, using, and disclosing personal information, except where otherwise permitted or required by law. By visiting our websites, purchasing products, enrolling in a program, submitting a form, or communicating with our team, you consent to the collection, use, and disclosure of your personal information as described in this Policy and for the purposes identified at the time of collection. Where we intend to use personal information for a new purpose not covered by this Policy, we will identify the new purpose and seek consent before proceeding, except where otherwise authorized by law. Withdrawing Consent You may withdraw consent at any time, subject to legal, contractual, or operational constraints, and subject to reasonable notice. Withdrawal of consent may affect our ability to provide certain services. To withdraw consent, contact us using the information in Section 15. Withdrawal of consent does not apply retroactively and does not affect processing that has already occurred. Marketing Communications Where you have subscribed to marketing emails, newsletters, SMS communications, or promotional content, you may withdraw marketing consent at any time by using the unsubscribe mechanism included in those communications, or by contacting us directly. All commercial electronic messages are sent in compliance with Canada's Anti-Spam Legislation (CASL), which requires that we obtain your express or implied consent, identify ourselves as the sender, and provide a functioning unsubscribe mechanism in every message. Transactional and operational communications related to active orders, bookings, or accounts are not subject to marketing opt-out. Limiting Collection We collect only the personal information necessary for the purposes identified in Section 2. Collection is by fair and lawful means. Limiting Use, Disclosure, and Retention Personal information is used and disclosed only for the purposes described in this Policy or as subsequently identified and consented to, except where otherwise permitted or required by law. We do not sell personal information. Third-Party Service Providers We may share personal information with trusted third-party service providers engaged to assist in operating our business. These providers are permitted to access only the information reasonably necessary to perform services on our behalf and are required to protect personal information in a manner consistent with our obligations. Categories of service providers include: eCommerce and payment processing (e.g., Shopify, Shopify Payments, Stripe, PayPal, Affirm) Shipping and order fulfillment providers Marketing and advertising platforms (e.g., Google Ads, Meta Ads, YouTube) Website analytics and session tracking tools (e.g., Google Analytics) Lead tracking, call recording, and attribution platforms (e.g., WhatConverts) SMS and text message marketing platforms (e.g., Klaviyo) Customer relationship management and scheduling systems Online learning and student portal platforms Cloud storage and data hosting providers Email marketing and communication platforms Payment Information Payments are processed through PCI-compliant third-party payment processors, including Shopify Payments, Stripe, PayPal, Affirm, and other authorized providers. McCann Dogs does not store full payment card numbers on its own servers. Payment card data is handled directly by our payment processors and is subject to their applicable privacy and security practices. SMS Opt-In Data Notwithstanding any other provision of this Policy describing data sharing or disclosure practices, telephone numbers collected for the purpose of SMS communications, and all opt-in consent records associated with our text messaging program, will not be shared with any third party for that third party's own marketing, promotional, or commercial purposes. Such information is disclosed only to service providers acting strictly on our behalf for the purpose of delivering and administering our SMS program, and only to the extent necessary for those purposes. Cross-Border Transfers Some service providers engaged by McCann Dogs may store or process personal information outside of Canada, including in the United States. As a result, personal information may be subject to the laws of those jurisdictions, including lawful access by government authorities. We take reasonable contractual steps to ensure that personal information transferred internationally receives a comparable level of protection. Legal Disclosure We may disclose personal information without consent where required or authorized by law, including in response to a court order, subpoena, warrant, or lawful demand from a government authority. Retention Personal information is retained only as long as reasonably necessary to fulfill the purposes for which it was collected, to comply with legal or regulatory obligations, to resolve disputes, or to enforce our agreements. Specific retention periods vary by information type and purpose. Call recordings, AI-generated transcripts, and analytics data may be retained for internal business, quality assurance, and marketing attribution purposes, subject to applicable retention limits. Mobile telephone numbers and SMS opt-in records are retained for the duration of the messaging relationship and for a reasonable period thereafter to demonstrate consent compliance. 6. Accuracy We make reasonable efforts to ensure that personal information in our custody is accurate, complete, and up to date for the purposes for which it is used. Individuals are encouraged to notify us of any changes to their information so that we can maintain accurate records. Requests for correction of inaccurate or incomplete personal information may be submitted using the contact information in Section 15. 7. Safeguards We use reasonable and appropriate administrative, technical, and physical safeguards to protect personal information against unauthorized access, use, disclosure, modification, or loss. These measures are proportionate to the sensitivity of the information and the risks associated with its handling. No method of electronic storage or internet transmission is completely secure. While we take reasonable precautions, we cannot guarantee absolute security. In the event of a material privacy breach that creates a real risk of significant harm, we will notify affected individuals and report to the Office of the Privacy Commissioner of Canada as required under PIPEDA's breach of security safeguards regulations. 8. Openness We make information about our privacy policies and practices readily available to individuals. This Privacy Policy is published on our website and may be updated periodically. Where material changes are made, we will post the updated Policy with a revised effective date. Cookies and Tracking Technologies Our websites use cookies, pixels, session tracking technologies, and similar tools to support website functionality, analytics, advertising, and eCommerce operations. Third-party platforms that may deploy tracking technologies on our websites include Google Analytics, Google Ads, Meta advertising tools, WhatConverts, Shopify, Klaviyo, and email and CRM platforms. You may configure your browser settings to disable certain cookies, though doing so may affect the functionality of some features. McCann Dogs' website uses cookies to help keep track of items you put into your shopping cart, including when you have abandoned your cart. This information is used to determine when to send cart reminder messages, which may include messages sent by text message where you have opted in to receive SMS communications from us. 9. Individual Access Individuals have the right to request access to personal information held about them by McCann Dogs, subject to applicable legal exceptions. Upon receipt of a written request and sufficient verification of identity, we will advise the individual of: the personal information we hold about them; the purposes for which it has been used or disclosed; and the names of third parties to whom it has been or may be disclosed. We will respond to access requests within 30 days of receipt, or provide written notice of an extension where a longer period is required. We may charge a reasonable fee to offset the cost of responding to an access request. Where a fee applies, we will provide an estimate in advance and will not process the request until the applicant has confirmed they wish to proceed. Where information is found to be inaccurate or incomplete, we will correct it upon request or append a notation of the correction request to the record. Challenging Compliance Individuals may direct questions, concerns, or complaints about our privacy practices, or about our compliance with PIPEDA or this Policy, to our Privacy Contact using the information provided in Section 15. We will investigate and respond to written complaints in a timely manner. Where a complaint is found to be justified, we will take appropriate corrective action. Individuals who are not satisfied with our response may escalate their complaint to the Office of the Privacy Commissioner of Canada at www.priv.gc.ca. 11. Children's Privacy Our services and programs may involve minors participating in training activities. However, our websites, online stores, and digital communications are directed at adult users. We do not knowingly collect personal information directly from individuals under 18 years of age without the knowledge and consent of a parent or guardian. Where a minor is enrolled in a program, personal information is collected from and consent is obtained from a parent or legal guardian. 12. Third-Party Links and Platforms Our websites and communications may contain links to or integrations with third-party websites, social media platforms, and applications. McCann Dogs is not responsible for the privacy practices, content, or security of third-party services. SMS and Text Message Communications McCann Dogs operates an SMS text messaging program to communicate with customers and prospective customers located in Canada and the United States who have expressly opted in to receive text messages from us. Canadian recipients are subject to Canada's Anti-Spam Legislation (CASL). Recipients located in the United States are subject to the Telephone Consumer Protection Act (TCPA) and applicable FCC regulations. This section describes how we collect, use, and manage mobile telephone numbers and related data in connection with that program, in compliance with both frameworks. Opt-In and Consent We send text messages only to individuals who have provided express written consent to receive SMS communications from McCann Dogs. Consent may be collected through: online opt-in forms on our website or landing pages; checkout and account registration flows where SMS opt-in is offered as a distinct and voluntary option; keyword opt-in programs where you text a designated keyword to our messaging number; or other documented points of consent where the nature of the messaging program is clearly disclosed. By opting in, you agree to receive recurring automated and non-automated text messages from McCann Dogs, which may include order and booking confirmations, training reminders, promotional content, product updates, and cart reminder messages. Message frequency will vary depending on your activity and the program you have joined. Msg & data rates may apply. Consent to receive text messages is not a condition of purchasing any product or enrolling in any program. How We Use Your Mobile Number Mobile telephone numbers collected through our SMS program are used to: send transactional messages related to orders, bookings, class schedules, and account activity; send promotional messages, training resources, product announcements, and offers where you have opted in to receive such content; send cart abandonment reminders where our website has identified that items were added to your cart but the purchase was not completed; and communicate time-sensitive or operational information relevant to your relationship with McCann Dogs. Cart Abandonment and Automated Messaging McCann Dogs' website uses cookies and session tracking technologies to identify when items have been added to a shopping cart and a purchase has not been completed. Where you have opted in to receive text messages, this information may be used to trigger automated cart reminder messages sent to your mobile telephone number. No cart abandonment text message will be sent unless you have provided express prior consent to receive SMS communications from us. Sharing of SMS Opt-In Data Telephone numbers collected through our SMS program, and all opt-in consent records associated with that program, will not be shared with any non-affiliated third party for that party's own marketing, advertising, or promotional purposes. For clarity, text messaging originator opt-in data and consent are expressly excluded from any data sharing arrangements described elsewhere in this Policy. Such information is disclosed only to service providers acting on our behalf solely for the purpose of delivering and administering our messaging program. How to Opt Out You may opt out of receiving text messages from McCann Dogs at any time by: replying STOP to any text message you receive from us; texting STOP to our messaging number; or contacting us directly using the information in Section 15. Upon receipt of a valid opt-out request, we will send a single confirmation message and cease sending further text messages, subject to any messages already in transit at the time of opt-out. Opting out of SMS communications does not affect your receipt of email communications or other operational notices, which are governed separately. To re-subscribe after opting out, text START to our messaging number or opt in again through the applicable form on our website. Applicable Law and Regulatory Compliance Our SMS program is operated in compliance with Canada's Anti-Spam Legislation (CASL) for Canadian recipients and the Telephone Consumer Protection Act (TCPA) for recipients located in the United States. We obtain express written consent prior to sending any commercial or promotional text message. All opt-in records, including the date, time, method of consent, and the disclosure provided at the point of opt-in, are retained for the duration of the messaging relationship and for a minimum of four years thereafter to satisfy TCPA recordkeeping requirements. Consumers in the United States may also contact the Federal Communications Commission (www.fcc.gov) or the Federal Trade Commission (www.ftc.gov) with complaints related to unwanted text messages. Message and Data Rates Standard message and data rates may apply to text messages sent to and from McCann Dogs, depending on your mobile carrier plan. McCann Dogs is not responsible for any charges applied by your carrier in connection with SMS communications. 15.
